Your Obligations and Responsibilities

Inaccurate information may affect our ability to provide appropriate services or communicate with you effectively.

If your information changes, you agree to update it promptly. Failure to maintain accurate information may result in service disruptions or cancellation of bookings.

2. Respectful Conduct

Our tea ceremonies and consultations are designed as contemplative experiences. You agree to:

• Arrive on time and prepared for your scheduled experience
• Respect the quiet, contemplative nature of the space
• Treat our staff, space, and other participants with courtesy and respect
• Follow any guidance or instructions provided during your experience
• Refrain from disruptive behavior that interferes with others' experiences

3. Health and Safety Responsibilities

You are responsible for your own health and well-being when participating in our services. This includes:

• Disclosing any allergies, sensitivities, or health conditions that may be affected by tea consumption
• Understanding your own caffeine tolerance and limitations
• Consulting with healthcare professionals before participating if you have concerns
• Informing us immediately if you feel unwell during any experience

4. Payment Obligations

You agree to pay all fees associated with services you book in a timely manner. This includes honoring our cancellation policy and any associated fees. Payment information must be valid and authorized for use. Chargebacks initiated without first attempting to resolve issues with us may result in denial of future services.

5. Compliance with Laws

You agree to comply with all applicable local, state, federal, and international laws and regulations when using our services or website. This includes laws related to data privacy, consumer protection, and online conduct. You are solely responsible for ensuring your actions comply with applicable laws in your jurisdiction.

Disclaimers, Warranties, and Liability

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Moonpetal disclaims all warranties, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that our services will be uninterrupted, secure, or error-free
• Warranties regarding specific health benefits or wellness outcomes

While we strive to provide meaningful, high-quality experiences, we make no guarantees about the results you may experience. Individual outcomes vary, and the benefits you receive depend on many factors including your own engagement, openness, and personal circumstances.

Not Medical or Therapeutic Services

Our tea ceremonies and wellness consultations are not medical treatments, therapy sessions, or professional healthcare services. They are designed for relaxation, contemplation, and personal enrichment. We do not diagnose, treat, cure, or prevent any disease or medical condition. If you have health concerns, please consult qualified medical professionals.

Limitation of Liability

To the maximum extent permitted by law, Moonpetal, its founders, employees, contractors, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage arising from your use of our services
• Damages resulting from unauthorized access to your personal information
• Any other matter relating to our services or website

In any case, our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid us for the specific service in question, or $100, whichever is less.

Force Majeure

We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of government, labor disputes, pandemics, power failures, or internet service disruptions. In such cases, we will make reasonable efforts to notify you and reschedule or refund as appropriate.

Your Indemnification Obligations

You agree to defend, indemnify, and hold harmless Moonpetal, its founders, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

• Your use or misuse of our services or website
• Your violation of these Terms or any applicable law
• Your violation of any rights of another person or entity
• Any content or information you provide to us
• Your conduct during any tea ceremony or consultation

This indemnification obligation will survive the termination or expiration of these Terms and your use of our services.

Dispute Resolution and Legal Provisions

Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve any dispute informally. Most concerns can be addressed through good-faith communication. We commit to working with you to find reasonable solutions to any problems that arise.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the United States, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction and venue in such courts.

Time Limitation on Claims

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of our services or these Terms must be filed within one year after such claim or cause of action arose, or be forever barred.

Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and Moonpetal agree to waive any right to have disputes resolved through class action.

Modifications to Terms

Moonpetal reserves the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services. We encourage you to review these Terms periodically for any changes.

Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect and shall be construed to give effect to the intent of these Terms.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver by Moonpetal of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any waiver must be in writing and signed by an authorized representative of Moonpetal.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, Terms of Service, and any other legal notices or agreements published by Moonpetal on our website, constitute the entire agreement between you and Moonpetal regarding your use of our services. These Terms supersede and replace any prior agreements, understandings, or arrangements between you and Moonpetal, whether written or oral, regarding such subject matter.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. Moonpetal may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

Survival

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, dispute resolution provisions, and this survival clause.

By using our services or website, you acknowledge that:
